After much consideration and listening to feedback about how loud UTVs disturb the peace of residents, Innsbrook Owners Association Trustees recently made an amendment to the Declaration of Trust and Restrictions for the community. This amendment applies to gas and diesel powered UTVs. The new rule is as follows:

“No Owner shall operate a Gas or Diesel Operated Utility Terrain Vehicle (hereinafter non-conforming vehicles) on any Innsbrook Road or Common.

Effective April 1, 2024 no previously unregistered gas or diesel-powered Utility vehicles may be allowed to register within the Development.

Non-conforming vehicles registered with the Owners Association shall be deemed authorized until January 1, 2029 and thereafter shall be subject to the penalties set forth in Section 4.22 (b) (1).”

This means that all owners with gas or diesel powered UTVs must register with Innsbrook (if not already registered) for a recreational vehicle permit/sticker prior to April 1, 2024. Gas or diesel powered UTVs that are registered before April 1, 2024, will be allowed onsite through the grace period ending January 1, 2029.

No gas or diesel-powered UTVs will be allowed on residential lots or common ground after April 1, 2024 (unless previously registered before that date). Previously registered UTVs will be allowed to operate on site through 2029.

After this time, no gas or diesel powered UTVs will be allowed to operate in Innsbrook Resort. Violators will be subject to fines for operating or maintaining UTVs at Innsbrook.

The amendment includes remedies for violations as follows:

4.22 (b) (1). Enforcement, Violations and Penalties. Section 4.22 (b) may be enforced by the Trustees of the Innsbrook Owners Association, the Innsbrook Corporation Security Department, or any authorized agent of any of the foregoing. Any Owner that violates any provision of Section 4.22 (c) shall be subject to a fine by the Innsbrook Owners Association, either directly or through the Security Department. Prior to the issuance of any fine, the Owner shall be provided with a written warning that states the regulatory provision that is being violated. Upon the first failure of such person to cease or cure a violation within ten (10) days of a written warning, there may be a fine imposed of up to $250 for each day during which a violation continues. Upon a second or subsequent violation of the same provision, the IOA may impose a fine of up to $500 for each day during which a violation continues. In addition, upon the third or subsequent violation of the same provision, the IOA may impose a fine of up to $500 and may seek an injunction to restrain a person from any further violation of said provision, such remedy being in addition to all other remedies available at law, equity or otherwise. In addition to any monetary fine violation of this Indenture may result in the loss of common ground privileges for the offending property owner.

The amendment also requires UTV registration with the IOA:

4.22(b)(2) Registration and Vehicle Tag Display. All UTVs must be registered with the Innsbrook Owners Association.

Any UTV that is required under the provision of this chapter must affix and display prominently at all times an Innsbrook issued RFID security windshield sticker. Failure to comply with the provisions of this section shall subject the UTV owner to the provisions enumerated in Section 4.22 (b)(1) above.
